Subject:   Admissions for GNM course- academic session 2004-05 and the order of the Hon’ble High Court in COCP No. 171/04.

 

            The State Government in its notification dated 5/7/2004 did not permit your institution to make admissions in the academic year 2004-05 because you did not possess Indian Nursing Council  feasibility certificate.  You had filed COCP No. 171/04 against the State Government and Punjab Nurses Registration Council on the ground that they were insisting upon Indian Nursing Council  certificate which was not required as per the High Court order dated 21/4/2003.

 

2.         The case was heard by the Hon’ble High Court on 3/8/2004.  The State Government explained to the Hon’ble court that unless the institution had feasibility certificate/recognition from  the Indian Nursing Council, the students will not be eligible for job abroad and outside the State of Punjab.  The Hon’ble court felt that there was merit in the argument of the state government but he was helpless in view of the earlier High Court order declaring that Indian Nursing Council certificate was not required.  The court felt that the state government had to permit admissions in your institution and the government could take other steps  in the interest of the general public and the students.  We were asked to permit admissions by 5/8/2004. The copy of the order of the Hon’ble High Court has yet not received and therefore this letter is being issued subject to the condition it will liable to revision if necessary after the receipt of the copy of the order of the Hon’ble High Court.

 

3.         You are accordingly permitted to make admissions for the GNM course for 50 seats during the year 2004 even though you do not possess Indian Nursing Council  certificate, in compliance with the order of the High Court as mentioned above with the following conditions:-

 

(a)        That you will have Punjab Nurses Registration Council affiliation for the year 2004-05.
 

(b)        You will write in bracket in bold letters below the name of your institution whereever appearing the following words, “NOT RECOGNISED BY INDIAN NURSING COUNCIL” This would be written on the name plate/board of the institution, in all the letters of the institution, prospectus, advertisement appearing in the newspapers etc.

(c)        
The following lines would be printed on the application form and would be signed by the students admitted in the institutions-
 

That I have been explained by the Principal that this institution is not recognised by the Indian Nursing Council (INC) and it does not have any feasibility certificate from the INC.  I also know that without Indian Nursing Council  feasibility  certificate I will not be eligible for jobs outside the state of Punjab and in foreign countries.  I am knowingly taking admission and will not make any claim against the government.”

 

(d)        Non compliance of above instructions would amount to deception and misleading the students and you would be subject to both civil and criminal liability.
 

(e)        In the event of students complaining to the government and the above conditions not being met by the institution the government would be at liberty to shift the students to other institutions and you would be liable to refund the entire amount received from those students.  It is made clear that this would not absolve you from criminal/civil liability.
 

(f)         A copy of this letter would be placed on the notice board would also be printed in the prospectus and attached with every application form.

 

Any  violation of this letter and conditions would invite appropriate action from the government and the Council.
