ORDER FFC 5-7-2004 UT COLLEGES

 

CHAIRMAN, COMMITTEE FOR FEE FIXATION OF PRIVATE MEDICAL PROFESSIONAL COLLEGES, AT CHANDIGARH.

 

Subject:    Fee fixation for admission for the Private Medical Institutions under the Chandigarh Administration.

 

JUDGEMENT

 

The letter under endorsement No.GMC-TA-1(23)-2004/18214-15, dated June 10, 2004 from the Chandigarh Administration reads thus:

        “I am directed to refer to the subject cited above and to say that the Chandigarh Administration is following the State of Punjab in matter relating to fixation of Fee in respect privately managed unaided Institutions under the Chandigarh Administration and we have not appointed separate Committee for this purpose. Accordingly, it is requested that the views of the Managements of the following 02 Colleges functioning under Chandigarh Administration may kindly be taken into consideration by the Committee appointed by the State of Punjab under the Chairmanship of Hon’ble Justice G.R.Majithia (Retd.).

 

1.     Homeopathic Medical College, Sector 26, Chandigarh.

2.     Shri Dhanwantry Ayurvedic Medical College & Hospital, Sector 46, Chndigarh.”

This letter was received in the Office of Member Secretary on June 14, 2004

This file was sent to me with the following Note dated 24/6/2004 recorded by the Member Secretary:-

“1.     Chairman may kindly see papers relating to Medical Institutions in Chandigarh.

2.      They have decided vide letter dated 10.6.2004 to have the fee fixed from our Committee.”

 

On June 25, 2004, I passed the following order:- 

“File perused. Pending final decision by the Fee Fixation Committee, the College (Dhanwantry Ayurvedic & Hospital) be advised to charge tuition fee for the session 2004-05 as approved by the Syndicate, Punjab University for the year 2003-04. An undertaking will be obtained from the students that they will pay the higher tuition fee, if fixed by the Fee Fixation Committee. Please put up the matter in the meeting of Fee Fixation Committee as and when held. Please obtain  approval of other members of Fee Fixation Committee before issuing the order on telephone.”

Shri Dhanwantry Ayurvedic College and Hospital filed a Second Petition that the interim fee be fixed by the Fee Fixation Committee after hearing them.  The Fee Fixation Committee’s meeting was convened for July 5,2005 and the college, the parents, the students, the representative of the University and the Chandigarh Administration were heard.

The representative of the Chandigarh Administration brought to our notice that in the meeting dated March 23, 2004 convened by the Chandigarh Administration.  Dr. Krishan Baldev, Principal, Shri Dhanwantry Ayurvedic College & Hospital participated.  It was agreed up thus:-

“Fee structure will be the same as intimated by the Punjab University and approved by the Chandigarh Administration on Punjab Pattern.”

It was pointed out that Dr. Krishan Baldev refused to sign the Minutes of the Meeting.

 

The record of the University was perused.  I found that for the year 2003-04, the Syndicate took the unanimous decision after lengthy discussion.  The decision of the Syndicate was conveyed to the Chandigarh Administration and the College.  It was accepted and acted upon.  The fee fixed in the Syndicate’s meeting has been alluded to in the 2nd paragraph of the judgment.  I find that in the Centralized Admission Brochure for MBBS/BAMS/BHMS Courses, Session 2004, at Para-5 it is stated thus:-

 

4.     Spot payment at the time of admission:-

 

BAMS

General Category         Rs. 50,000/- p.a. + Rs. 5000/-

                                  Security Advance refundable.

 

SC                               Rs. 50,000/- p.a. + 5000/-

                                   Security Advance refundable.

 

ST                                Rs. 50,000/- p.a. + 5000/-

                                    Security Advance refundable.

The fee structure mentioned in the brochure is the same, which was approved by the Syndicate for the year 2003-04. I do not think that the College has made out any case for not reiterating our earlier decision.  The decision of the Committee earlier taken is reiterated.
